It’s not just Sam Brownback who promises to outlaw abortion if elected president of the United States. Tom Tancredo promised the same during the Values Voter Debate of September 17 2007, referring to his fellow Republican candidates and to himself:
Of course I believe all of us would appoint judges who would do exactly what we’ve said here and overturn Roe vs. Wade. I guarantee you I would do that. That would be a litmus test.
Right from the Republican presidential candidate’s mouth: you vote for a Republican in 2008, and abortion will be made illegal. The choice is stark and clear.

The Republicans used to have a “gentleman’s” agreement. They would talk tough about abortion in order to get elected but they would not actually do anything to change the law. I guess they didn’t want all the hookers in DC coming up with paternity suits or their personal fortunes being subjected to a lot of heirs on the wrong side of the blanket. Looks like that’s all changed now.
Sorry for being a stickler on Constitutional Law, but Roe v. Wade being overturned would not make abortion illegal.
It would give the states the power, just as in pre Roe v. Wade, to pass laws outlawing abortion.
It’s the same as making abortion illegal in some states (such as ones that have passed laws outlawing abortion if and when Roe v. Wade is overturned). But overall, it doesn’t make abortion illegal.
What you’ve said isn’t wrong, and I don’t think it contradicts what I’ve said. It will make abortion illegal — the locations of that illegality will vary, yes, but it will make abortion illegal.
