Campaign Legal Center Enters Interminable Unity08 Lawsuit

In the first case filings in seven months’ time, The Campaign Legal Center entered an amici curiae brief just before Christmas along with group Democracy 21 in Unity08 v. FEC, a brief in support of the FEC’s position that Unity08 must file disclosures with loan details as a political committee. Unity08 sued the FEC at the beginning of last year in order to avoid such detailed loan disclosures and contribution limits. I encourage you to read the brief for yourself.

In motions associated with the brief the CLC barely veils its disappointment with DC circuit judge Richard W. Roberts for allowing the case to drag on to the point that it is practically irrelevant — after all this time with Roberts sitting on the case, Unity08 will be holding (or not) its nomination in just a few short months. As the CLC notes, Judge Roberts hasn’t even scheduled oral arguments. The CLC also shows disdain for the Federal Election Commission, asserting that it filed the amici curiae brief because it lacked confidence in the skill and exhaustiveness of the FEC’s legal arguments.

In other non-existent news in the case, Judge Roberts is scheduled to pick his armpit and examine his hair in the mirror shortly.
